This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "User") and Analytic Endeavors Inc. ("Analytic Endeavors", "we", "us") governing your use of the AE Diagram Tool Microsoft PowerPoint add-in and its related web services (together, the "Add-in"). By installing or using the Add-in, you agree to be bound by this Agreement. If you do not agree, do not install or use the Add-in.
Subject to your compliance with this Agreement, Analytic Endeavors grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Add-in for your internal business or personal presentation purposes.
Placing your saved diagrams requires a free Analytic Endeavors account. You are responsible for activity under your account and for keeping your sign-in credentials and connection codes confidential. Diagrams already placed on a slide can be viewed by your audience without an account.
You will not, and will not permit others to:
The Add-in, including its software, design, and content, is owned by Analytic Endeavors and is protected by intellectual property laws. Except for the license granted above, no rights are transferred to you. The architecture diagrams and other content you create with the Add-in remain yours.
Your handling of your diagrams and account data is described in our Privacy Policy, which is incorporated into this Agreement by reference.
The Add-in runs inside Microsoft PowerPoint and is distributed via Microsoft AppSource. Analytic Endeavors is not affiliated with, endorsed by, or sponsored by Microsoft. Your use of Microsoft products is governed by your agreements with Microsoft.
The Add-in is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Analytic Endeavors does not warrant that the Add-in will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Analytic Endeavors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Add-in. Our total liability for any claim relating to the Add-in will not exceed the greater of the amount you paid for the Add-in (if any) or USD $50.
This Agreement is effective until terminated. It terminates automatically if you breach it. We may suspend or terminate the Add-in or your access at any time. On termination, you must stop using and uninstall the Add-in. Sections 4 through 10 survive termination.
We may update this Agreement from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Add-in after changes take effect constitutes acceptance.
This Agreement is governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules.
